1. Acceptance of Terms

Welcome to GreenMargins. By accessing or using our landscaping quote calculator and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

GreenMargins provides a web-based quote calculator designed for landscaping businesses. The Service includes tools for calculating job costs, generating quotes, managing customers, tracking materials, and related business functions.

3. Account Registration

To use the Service, you must:

  • Be at least 18 years old or the age of majority in your jurisdiction
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4. Subscription and Payment

4.1 Subscription Plans

The Service is offered on a subscription basis. Features and limits vary by plan. Current pricing is available at greenmargins.com/pricing.

4.2 Free Trial

New accounts receive a 14-day free trial. A valid payment method is required to start. You will not be charged during the trial period. At the end of the trial, your selected plan will begin billing automatically unless you cancel.

4.3 Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as provided in Section 4.4
  • We may change prices with 30 days notice
  • You are responsible for applicable taxes

4.4 Refunds

We offer a 30-day money-back guarantee. If you are not satisfied within 30 days of your first payment, contact us for a full refund.

4.5 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You retain access until then.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Upload malicious code or content
  • Use automated tools to access the Service without permission
  • Resell or redistribute the Service without authorization
  • Use the Service to send spam or unsolicited communications

6. Your Data

6.1 Ownership

You retain ownership of all data you submit to the Service ("Your Data"). You grant us a limited license to use Your Data solely to provide and improve the Service.

6.2 Data Export

You may export Your Data at any time through the Service interface or by contacting support.

6.3 Data Deletion

Upon account deletion, we will delete Your Data within 90 days, except where retention is required by law.

7. Intellectual Property

The Service, including its design, features, and content, is owned by GreenMargins and protected by intellectual property laws. You may not copy, modify, or create derivative works from the Service.

GreenMargins and its logos are trademarks. You may not use them without our written permission.

8. Third-Party Services

The Service may integrate with third-party services (e.g., payment processors, mapping services). Your use of these services is subject to their terms. We are not responsible for third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • Defects will be corrected
  • The Service is free of viruses or harmful components
  • The results from using the Service will be accurate or reliable

You use the Service at your own risk. We are not liable for any decisions you make based on calculations or quotes generated by the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GREENMARGINS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless GreenMargins, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.

12. Termination

We may suspend or terminate your account if you violate these Terms or for any other reason with or without notice. Upon termination:

  • Your right to use the Service ends immediately
  • You remain liable for any outstanding fees
  • Sections that should survive termination will survive (e.g., Limitation of Liability, Indemnification)

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.

14. Dispute Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us. If we cannot resolve the dispute within 30 days, either party may proceed with formal proceedings.

15. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and GreenMargins.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Failure to enforce any right does not waive that right.
  • Assignment: You may not assign these Terms. We may assign them without restriction.
  • Force Majeure: We are not liable for delays or failures due to circumstances beyond our control.
